Terms and Conditions for Everlane Online

1. Provider and scope

Everlane Online is provided by ECLE - Emerv Creveo Life Empire, owner Fabian Hartmann, c/o flexdienst – #21189, Kurt-Schumacher-Straße 74, 67663 Kaiserslautern, Germany, e-mail: support@everlane-online.de (“we”). These terms apply to the game and its online features. You expressly agree to them in the game before creating an account and before logging in. Apple's Standard Licensed Application End User License Agreement (EULA) also applies to the app itself.

2. Free to play, purchases in the Everlane Mall

Everlane Online is free to play and shows no advertising. If you wish, you can shop in the Everlane Mall (SHOP tile at the top of the bar) with Stars. The following applies:

• Buying Stars: You buy Stars with real money as an in-app purchase in the App Store. You make this purchase with Apple: Apple shows you the price in your local currency, takes the payment and is responsible for billing and refunds; Apple's terms apply. You request a refund from Apple, for example at https://reportaproblem.apple.com.
• Crediting: Our server checks every purchase with Apple itself and credits the Stars exactly once – to the Everlane account you are logged in with in the game when the purchase is booked with us. This needs a connection to our server; until then the purchase waits and is booked later.
• What Stars are: Stars are the virtual currency of the Everlane Mall. They belong to your Everlane account, are valid in every world, and only our server keeps their balance. Stars have no cash value, cannot be exchanged back into real money or paid out, and cannot be transferred to other accounts or players.
• Shopping: Prices in Stars are shown in the Everlane Mall; discounts only apply during the period shown. You can only shop with a connection to our server and inside a world. We deduct the Stars as soon as you buy. If the price has changed in the meantime, the purchase does not go through and the game shows you the new price. The goods arrive as a delivery in the mail of the world you bought them in (Everlane Mall mailbox or Social › Mail) and are credited exactly once when you collect them. Section 7 applies to goods you buy.
• Loyalty Bonus and offers: We grant the daily Loyalty Bonus and discounts voluntarily; there is no entitlement to them, and we may change or end them. The Loyalty Bonus never contains Stars.
• Refund by Apple: If Apple refunds a purchase, we deduct the Stars credited for it again, even if you have already spent them. Your balance can then fall below zero; while it is negative, you cannot buy anything in the Everlane Mall until new Stars balance it out. If Apple reverses the refund, we credit the Stars again.
• Account deletion: If you delete your account, unspent Stars and deliveries you have not yet collected are forfeited; we do not refund them.

Right of withdrawal: As a consumer, you generally have a statutory right of withdrawal for purchases made online. Apple's withdrawal and refund rules apply to buying Stars in the App Store. For contracts for digital content not supplied on a tangible medium, the right of withdrawal expires once performance has begun after you have expressly consented to performance beginning before the end of the withdrawal period, have acknowledged that you thereby lose your right of withdrawal once performance begins, and have been provided with a confirmation of the contract. We provide Stars and Everlane Mall goods immediately after purchase.

3. Account

• You need an account with an account name, e-mail address and password for the online features. Without the server you can also play with a local account on your device.
• Keep your login details secret. An account belongs to one person; selling, trading or passing on accounts is not allowed.
• The online features are intended for people aged 16 and over; younger players only with their parents' consent.

4. Conduct in the game and in chat

In chat, in voice chat and for account, character and family names:

• no insults, threats, harassment or bullying, no hate speech or discrimination;
• no sexual, violence-glorifying or otherwise unlawful content;
• no spam, no advertising, no links, no contact details;
• no personal data of others;
• no third-party brands or names of real people as names.

Also not allowed: fraud, exploiting bugs, cheat programs and bots, modified game versions, disrupting the server or other players' instances, and trading accounts or game content for real money.

5. Moderation, reporting, bans

• Zero tolerance: We have zero tolerance for objectionable content and for players who insult, harass, threaten or otherwise abuse others. We review reported content within 24 hours; if content violates these terms, we remove it and ban the account that caused it.
• You can report other players (tap the chat line › Report) and block them. If you block someone, their messages disappear from your view immediately and we are notified.
• We can remove messages, change names, issue warnings, suspend chat temporarily and ban accounts temporarily or, for serious or repeated violations, permanently. An automatic filter holds back insults, links and contact details.
• Save game check: If you play with an account on our server, the game syncs your save game with the server, and the server checks it automatically. It does not accept a save that cannot come about in the game; the most recently accepted save then applies again, updated with Bazaar, trades and deliveries since then. If a save shows something an honest game hardly ever produces, the server locks the Bazaar and trading for that character until we have reviewed the save; a suspicious gain in gold locks them until it has evened out with playing time. You can keep playing as normal.
• We give reasons for our measures; you see them when logging in or in chat. You can appeal a measure via the contact form or by e-mail.

6. Playing together over a direct connection

Family instances and raids with friends are opened by one player on their device; the others connect to it directly. Everyone involved can see each other's IP addresses, and the host runs the instance. Only play there with people you trust. We cannot be responsible for disruptions or losses in other players' instances; you can still report violations of these terms to us.

7. Virtual content

Gold, items, equipment, specialist cards, companions, experience and ranks are part of the game, and so are Stars and goods from the Everlane Mall. You acquire a simple, non-transferable right to use them in the game, not ownership. They have no value outside the game and cannot be exchanged for real money. We may develop and adjust game content, values and mechanics (for example balancing classes, monsters and rewards) to the extent reasonable for you.

8. Availability

We strive to provide the online features permanently but cannot guarantee uninterrupted availability (maintenance, outages). Should we discontinue the online features, we will announce this in the game at least 30 days in advance.

9. Termination and account deletion

• You can delete your account in the game at any time (MENU › Account › Delete account). These terms then end for the online features.
• Together with the account, we also delete your save games on our server, your Bazaar listings including the items listed, deliveries not yet collected and your Stars balance (section 2).
• We can suspend or terminate an account for serious or repeated violations.

10. Liability

We are liable without limitation for intent and gross negligence, in accordance with statutory provisions for injury to life, body or health, and under the Product Liability Act. Otherwise we are only liable for breaches of essential contractual obligations, limited to the foreseeable damage typical for the contract.

11. Changes to these terms

We may change these terms where objectively necessary (for example new features, a new legal situation). We will inform you of material changes in the game in good time; play then continues only after you agree again.

12. Applicable law

German law applies. Mandatory consumer protection provisions of your country of residence remain unaffected. The German version of these terms is authoritative.
